TERMS AND CONDITIONS OF SALE

  1. SELLER INFORMATION

  1. SCOPE AND ACCEPTANCE

These Terms and Conditions of Sale apply to all purchases of products made through maisonkiuno.com by consumers.

By placing an order, the customer confirms that they have read and accepted these Terms and Conditions of Sale, the Return and Refund Policy, the Shipping Policy, the Privacy Policy and, where applicable, the Pre-order Cancellation Policy.

The version applicable to an order is the version available on the website when the order is placed.

  1. PRODUCTS

Maison Kiuno sells clothing and fashion accessories. The essential characteristics, materials, available sizes, colours and prices of each product are shown on the relevant product page.

Maison Kiuno makes every reasonable effort to display product colours and details accurately. However, colours may vary slightly depending on the customer’s screen settings, lighting conditions or the characteristics of the materials.

Customers are responsible for consulting the product description and size information before placing an order.

  1. PRICES, TAXES AND CUSTOMS DUTIES

Prices are displayed in the currency applicable to the customer’s selected market. Applicable taxes are included or calculated according to the information displayed at checkout.

Delivery charges are shown before the customer confirms payment.

For deliveries outside the European Union, customs duties, import taxes or local charges may be imposed by the destination country. Unless expressly stated otherwise at checkout, these charges are not included in the product or delivery price and remain the customer’s responsibility.

Maison Kiuno benefits from the French VAT exemption scheme (“franchise en base de TVA”). VAT is not applicable pursuant to Article 293 B of the French General Tax Code.

  1. ORDERS

The customer selects the products and quantities they wish to purchase and verifies their basket before proceeding to checkout.

Before confirming the order, the customer must check the products, sizes, delivery address, contact details, delivery charges and total price.

An order becomes final after payment has been authorised and the customer has received an order confirmation email.

Maison Kiuno may refuse or cancel an order in the event of suspected fraud, payment failure, incorrect customer information, an obvious pricing error or unavailability of the ordered product. If payment has already been collected, the affected amount will be refunded.

  1. PAYMENT

Available payment methods are displayed at checkout and may include bank cards, PayPal, Apple Pay, Klarna or other payment services available for the customer’s location.

Payment is processed securely through Shopify Payments or the selected payment provider. Maison Kiuno does not directly store complete payment card details.

The customer guarantees that they are authorised to use the selected payment method.

  1. PRODUCT AVAILABILITY

Products not identified as pre-order products are sold subject to available stock.

If a product becomes unavailable after an order has been placed, Maison Kiuno will inform the customer as soon as possible and offer either an alternative solution or a full refund for the unavailable product.

  1. HOODIE PRE-ORDERS

The Maison Kiuno hoodie may be offered for pre-order for a period of 60 days. The exact opening date, closing date and estimated shipping period will be displayed on the product page before purchase.

Production will begin only if a minimum of 50 confirmed pre-orders is reached by the end of the campaign.

If the minimum of 50 confirmed pre-orders is not reached, all affected orders will be automatically cancelled. Customers will receive a full refund, without cancellation fees, through their original payment method within a maximum of 14 days.

Customers may request cancellation of their hoodie pre-order before dispatch by contacting contact@maisonkiuno.com and providing their order number.

The hoodie is not a personalised product. The statutory right of withdrawal therefore remains applicable under the conditions described below.

  1. DELIVERY

Maison Kiuno currently delivers to France, the European Union, the United Kingdom, Switzerland, the United States and selected international destinations.

Available delivery methods, prices and estimated delivery times are displayed at checkout according to the destination and total package weight.

Orders are generally prepared within one to two business days after payment confirmation. Estimated transit times are:

France: 3–5 business days
European Union: 5–8 business days
Selected international destinations: 7–15 business days

Pre-order delivery times are specified separately on the relevant product page.

The customer must provide a complete and accurate delivery address. Maison Kiuno cannot be held responsible for delays or failed delivery resulting from incomplete or incorrect information supplied by the customer.

If delivery is delayed beyond the date or period announced, the customer may exercise the rights provided by applicable consumer law.

  1. RIGHT OF WITHDRAWAL AND RETURNS

Consumers have a statutory period of 14 days from receipt of their order to exercise their right of withdrawal without having to provide a reason.

For an order containing several products delivered separately, the period begins upon receipt of the final product.

The customer may exercise this right through the online return functionality, where available, or by contacting contact@maisonkiuno.com with their name, order number and an unambiguous statement expressing their decision to withdraw.

Products must be returned within 14 days after the customer communicates their decision to withdraw. Products should be returned unworn, unwashed and, where possible, with their original labels and packaging.

The customer may inspect and try on clothing as they would in a physical shop. The customer may be responsible for any reduction in value caused by handling beyond what is necessary to establish the product’s nature, characteristics and proper functioning.

Unless the product is defective, damaged or incorrect, return shipping costs are borne by the customer.

  1. REFUNDS

When the right of withdrawal is validly exercised, Maison Kiuno will refund the payments received for the returned products, including the cost of standard delivery where required by law.

Additional delivery costs resulting from the customer selecting a more expensive delivery method than the standard option are not refundable.

The refund will be issued through the original payment method within 14 days of being informed of the customer’s decision to withdraw. Maison Kiuno may withhold the refund until the returned products have been received or until the customer provides proof of shipment, whichever occurs first.

  1. LEGAL GUARANTEES

Products sold by Maison Kiuno are covered by the mandatory legal guarantee of conformity and the legal guarantee against hidden defects under French law.

Under the legal guarantee of conformity, consumers may request that a non-conforming product be repaired or replaced under the conditions provided by law. If repair or replacement is impossible, cannot be completed within the legal period or causes a major inconvenience, the consumer may be entitled to a price reduction or termination of the sale.

The legal guarantee of conformity applies independently of any commercial guarantee.

The customer may also invoke the legal guarantee against hidden defects under Articles 1641 and following of the French Civil Code. The customer may choose to return the product and obtain a refund or keep it and obtain a reduction in price, subject to the applicable legal conditions.

To report a defective, damaged or non-conforming product, the customer should contact contact@maisonkiuno.com and provide the order number, a description of the issue and supporting photographs where possible.

  1. LIABILITY

Maison Kiuno is responsible for the proper performance of its obligations in accordance with applicable law.

Maison Kiuno cannot be held liable where failure or delay results from circumstances attributable to the customer, the unforeseeable and unavoidable act of a third party, or a force majeure event as recognised under French law.

Nothing in these Terms and Conditions excludes or limits the consumer’s mandatory statutory rights.

  1. INTELLECTUAL PROPERTY

The Maison Kiuno name, logos, designs, photographs, texts, graphics and other content available on maisonkiuno.com are protected by intellectual property law.

They may not be reproduced, distributed, modified or commercially used without prior written authorisation from Maison Kiuno.

  1. PERSONAL DATA

Personal data collected during an order is processed to manage payments, delivery, customer service, returns, legal obligations and, where consent has been given, marketing communications.

  1. COMPLAINTS AND CONSUMER MEDIATION

For any complaint, the customer should first contact Maison Kiuno:

Maison Kiuno will attempt to resolve the complaint amicably.

If no satisfactory solution is reached after a prior written complaint, consumers may refer the dispute free of charge to the consumer mediator appointed by Maison Kiuno.

  1. GOVERNING LAW AND DISPUTES

These Terms and Conditions of Sale are governed by French law, without depriving consumers residing in another country of any mandatory protection granted by the law of their country of residence.

In the event of a dispute, the parties will first attempt to reach an amicable solution.

If no amicable solution is reached, the consumer may bring proceedings before any court having jurisdiction under applicable consumer and procedural law.
